How the FCC’s Secure Networks Act Is Intensifying Trade Compliance for U.S. Businesses

“Where the Covered List once was limited to telecommunications and surveillance products sold by a handful of vendors, it has now been expanded to cover connected devices in seemingly unrelated industries [drones/UAVs, power inverters, robotic devices, and routers]—and to capture products manufactured by any foreign vendor within those industries unless the manufacturer obtains an exception,” Lindsay Wardlaw, trade compliance lawyer and the founder of Wardlaw Trade Law, said. . . . “If you are somebody who relies on these products, I think you have to start thinking about whether you have a stable supply for now, and whether you have replacement parts stocked up in case they become unimportable in the future,” Wardlaw said.

BIS Could Control Remote Access to Chips Without Traditional Rulemaking, Lawyer Says

The Bureau of Industry and Security could begin controlling remote access to advanced chips without issuing a set of new export regulations, and it may do so even as related legislation in Congress remains stalled, panelists said during a recent American Bar Association event. . . . BIS more than a decade ago issued advisory opinions that said cloud services and remote access aren’t subject to the Export Administration Regulations (see 2402020050), but Wardlaw said BIS could revoke those advisory opinions.

The Tariff Mitigation Strategies That Actually Matter, According to a Licensed Trade Attorney

“If you are wrong in determining what the country of origin for your procured good is, that can have significant effects on both the tariff rate you owe and on whether or not you’re accused of customs fraud,” Wardlaw pointed out. . . That said, “[y]ou should have autonomy to design your product however you want and manufacture it however you want, even if that means designing it to achieve lower duties,” Wardlaw said. “The key is that you can’t practice any deception or fraud.”

TV Interview with Omar Butt of Pakistan TV's Beyond Borders Regarding U.S. Sanctions and Maritime Law in the Strait of Hormuz

The United Nations Convention on the Law of the Sea requires commercial vessels to be allowed through the Strait of Hormuz, but Iran claims broader authority under its domestic law despite not ratifying the convention: Lindsay Wardlaw, US-based International Trade Attorney.

U.S. Plans to Remove Syria From Terrorism Sponsor List

“Now [once Syria is removed from Country Group E] they may be able to export, reexport, or transfer equipment, software, and technology that was previously off limits to Syria without seeking U.S. government approval,” Wardlaw told Risk Journal. “Setting up an office, manufacturing facility, rig, or other infrastructure becomes viable, as does making sales of many dual-use items.”

The Justices Take On Tariffs: Key Takeaways

“Both Justices Gorsuch and Barrett, who spent a lot of time questioning the Solicitor General and seemed the most skeptical of the Solicitor General’s arguments, also seemed the most eager to find some way to read the statute that would still permit the government’s actions, in my opinion, Wardlaw told The Export Practitioner. . . . [But] “[t]he Trump administration is likely carefully considering its options for reauthorizing the tariffs in light of this discussion,” Wardlaw remarked.
